@SamRochadotcom @isisvande @ChrisSchaef I chose equality under the law first because it is less ambiguous and because mainstream conservatives--National Review and Ben Shapiro, say--explicitly favor it. What social equality entails and requires is much more ambiguous and contested, but let's turn to that. — PolitiTweet.org

@isisvande @SamRochadotcom @ChrisSchaef I disagree that *that* is the prevailing spirit of the law. It seems to me that it is intended to be aimed at left-racial essentialism but could well chill speech far beyond that. The kind of statement I think it is targeting is something like "All white people are oppressors." — PolitiTweet.org

@isisvande @SamRochadotcom @ChrisSchaef Agree RE free speech. RE Jim Crow, "was determined by the flawed logic of that system" is different than "is necessary determined" present tense are very different — PolitiTweet.org

@SamRochadotcom @isisvande @ChrisSchaef The reforms of the civil rights are all written as rights and protections that apply to everyone. I don't think any of the civil rights laws run afoul of clause 3. I don't like the anti-CRT laws but the problem with them is not that they're opposed to equality under the law. — PolitiTweet.org

@ChrisSchaef @SamRochadotcom Okay. What is the evidence for the proposition that what's really going on is invoking these words to "barely mask opposition to equality under the law"? What are specific examples of people using the words with that implicit intention? — PolitiTweet.org

@ChrisSchaef @SamRochadotcom Without making any claims about which is more important in a larger sense, the meaning of the critics is more important insofar as our purpose is to accurately understand what the beliefs of the critics are. — PolitiTweet.org

@ChrisSchaef @SamRochadotcom Do you think people who say *these football players shouldn't kneel* are at bottom saying *we don't think the cops should treat people equally* or *we consider the National Anthem and American flag to be sacred symbols and regard kneeling at that moment as disrespecting them*? — PolitiTweet.org
