I think the way to think about it is that is that as the court shifts right, conservative lawyers get more aggressive in what cases they’ll litigate (and liberal ones less so) so you continue to get frequent 5-4 decisions. If you win all the time, you aren’t pushing enough. — PolitiTweet.org
