@joshHuder I think it’s relevant when the reason Democrats went with a concurrent resolution over a joint resolution was not because they internally believed that was the proper course, but because a concurrent resolution would avoid an MTR. I could see a narrow ruling based on that. — PolitiTweet.org

Just now thinking that this whole concurrent resolution v. joint resolution dispute is going to end up in a court and judges are going to have to learn about the 2019 Democratic Caucus’s problems with Motions to Recommit. — PolitiTweet.org

@Fritschner ...in the absence of a statutory authority. The administration has made it clear that they believe they have the authority. — PolitiTweet.org

@Fritschner I’d be receptive to this argument (1) if there wasn’t a catchall AUMF just lying around, and (2) if leadership hadn’t sought to do this as a Joint Resolution. They ultimately went with the Concurrent Resolution because it didn’t require an MTR, not because this is how it’s done. — PolitiTweet.org

@Fritschner I mean, I’m with you. But that’s simply not what the administration thinks. Also, don’t forget the word “harbored.” I think that was why Pence had that whole thing about 9/11 terrorists going through Iran. — PolitiTweet.org

Can’t be sure of what move they’re on and who’s white or black — do Democrats or Republicans get to move first? — but I’ll annotate it as: 8. ...Bb5! 9. h5? — PolitiTweet.org

@Fritschner The administration claims they have a specific statutory authorization (2002 AUMF for any actions in Iraq, and 2001 for anything else they want). — PolitiTweet.org

Probably not a great sign for the whole "imminent threat" case that Sen. Mike Lee (R-Utah) called the intelligence briefing on Iran "the worst" he's ever been a part of, "insulting," and says he'll now vote to constrain the president's war-making capabilities. — PolitiTweet.org

Interestingly, the House resolution constraining Trump's war powers is a concurrent resolution, not a joint resolution, meaning it won't carry the force of law. It's more like a press release. Basically, it's an admission that this is not getting GOP support in the Senate. — PolitiTweet.org
