I’m assuming the 2003 ex post facto holding of Stogner v. CA (5-4) was mistaken and would be overruled today as to rapes committed in NY prior to the state’s 2006 elimination of the SOL for rape. Only Breyer & Ginsburg remain from the Stogner majority. Kennedy wrote the dissent. — PolitiTweet.org
