I would not be surprised if en banc review from DC Cir is sought or if #JudgeSullivan appeals himself. I also wonder why Judge does not simply hold #Flynn in contempt & punish accordingly. I view District Court as having that authority but I welcome other legal views. — PolitiTweet.org

@ScottShaneNYT I should add receiving & publishing classified info w/o authorization is also illegal but Govt has policy not to pursue criminal charges. But SCOTUS, in 1971 Pentagon Papers case, had four Justices agree prosecution was option. — PolitiTweet.org
