@broccolirobh88 In theory - good lord, I'm discussing this - there would be a 5-5 split that lets the 5th Circuit's decision stand. But it's pure fantasy. You need an act of Congress to expand the court, and a justice who wasn't present at oral arguments wouldn't get a vote on this. — PolitiTweet.org
